1. Acceptance of Terms

By downloading, installing, or using the Carmundo mobile application (“the App”), you agree to be bound by these Terms and Conditions (“Terms”). If you do not agree, you must not use the App.

These Terms constitute a legally binding agreement between you (“User,” “you,” “your”) and Carmundo (“we,” “us,” “our”).

2. Description of the Service

Carmundo is a community platform for car enthusiasts. The App allows users to:

• Create and manage personal profiles
• Build a virtual garage showcasing their cars
• Discover and join car clubs (public, private, or elite)
• Create and participate in car meetups and events (free or paid)
• Purchase a Carmundo Pro subscription for premium features
• Share posts with images and videos
• Follow other users and interact with their content
• Send direct messages to other users
• Receive notifications about community activity

3. Eligibility

You must be at least 16 years old to create an account and use the App. By using the App, you represent and warrant that you meet this age requirement.

If you are between 16 and 18 (or the age of majority in your jurisdiction), you must have the consent of a parent or legal guardian.

4. Account Registration

4.1 Account Creation

To access certain features, you must create an account using one of the following methods:

• Email and password
• Google Sign-In
• Apple Sign-In

You agree to provide accurate, current, and complete information during registration and to keep this information up to date.

4.2 Account Security

You are responsible for maintaining the confidentiality of your account credentials. You agree to notify us immediately of any unauthorized use of your account.

4.3 Account Termination

We reserve the right to suspend or terminate your account at any time if you violate these Terms or engage in behavior that is harmful to the community.

5. User Content

5.1 Ownership

You retain ownership of all content you create and share through the App, including posts, photos, videos, comments, and profile information (“User Content”).

5.2 License Grant

By posting User Content, you grant Carmundo a non-exclusive, worldwide, royalty-free, sublicensable, and transferable license to use, reproduce, modify, distribute, display, and perform your User Content in connection with operating and promoting the App. This license ends when you delete your User Content or your account, except where your content has been shared with others and they have not deleted it.

5.3 Content Guidelines

You agree not to post or share content that:

• Is illegal, threatening, abusive, harassing, defamatory, or obscene
• Infringes on any third party's intellectual property rights
• Contains viruses, malware, or other harmful code
• Promotes discrimination, hatred, or violence against any individual or group
• Is spam, misleading, or fraudulent
• Violates any applicable law or regulation
• Contains personal information of others without their consent
• Depicts or promotes dangerous driving, street racing, or illegal vehicle modifications

5.4 Content Moderation

We reserve the right to remove any User Content that violates these Terms or that we deem inappropriate, without prior notice.

6. Clubs

6.1 Club Creation and Management

Users may create and manage car clubs within the App. Club owners are responsible for the content and conduct within their clubs.

6.2 Club Access Levels

Clubs operate under one of three access levels:

• Public: Any user can view and join
• Private: Invitation-only; members can invite others
• Elite: Only club administrators can extend invitations

6.3 Club Owner Responsibilities

Club owners must ensure their clubs comply with these Terms and applicable laws. We are not responsible for the actions or content of club members.

7. Events and Meetups

7.1 Event Creation

Users may create car meetup events through the App. Event organizers are solely responsible for the planning, safety, and legal compliance of their events.

7.2 Paid Events and Tickets

Event organizers may set a ticket price for their events. When you purchase a ticket to a paid event:

• Payment is processed securely by Stripe. By completing a purchase, you agree to Stripe's Terms of Service.
• Your payment card details are collected and stored by Stripe — never by Carmundo.
• Upon successful payment, a ticket confirmation is issued to your account.
• Refunds: Refund requests for paid events must be directed to the event organizer. Carmundo does not issue refunds on behalf of organizers. Organizers are solely responsible for their own refund policy. This does not affect any statutory rights you may have under applicable law.
• Carmundo charges no additional booking or service fees at this time.

7.3 Organizer Responsibilities for Paid Events

If you create a paid event, you agree to:

• Clearly describe the event, including what is included in the ticket price.
• Honor your stated refund policy.
• Comply with all applicable laws regarding the collection and reporting of ticket revenue, including tax obligations.
• Not misrepresent the nature or quality of your event.

Carmundo reserves the right to remove paid events or suspend organizers who violate these obligations.

7.4 Disclaimer of Liability

Carmundo is a platform for discovering and organizing events. We do not organize, host, or supervise any in-person meetups or events. We are not liable for any damages, injuries, or losses that may occur at events discovered or organized through the App. Attendance at any event is at your own risk.

7.5 Event Location Data

Events may include geographic coordinates for discovery purposes. Users should exercise caution when sharing and visiting event locations.

8. Messaging

8.1 Direct Messages

The App provides direct messaging between users. You agree to use messaging responsibly and not to send unsolicited, abusive, or inappropriate messages.

8.2 Message Retention

Messages are stored on our servers. You may delete your messages, but copies may remain in the other participant's conversation history.

9. Subscriptions (Carmundo Pro)

9.1 What Is Carmundo Pro?

Carmundo Pro is an optional, paid subscription tier that unlocks premium features within the App. A complete and up-to-date list of Pro features is available in the App.

9.2 Billing and Payment

• Subscriptions are billed on a recurring basis (monthly or annual, as selected at purchase).
• Subscription purchases are processed through the Apple App Store (iOS) or Google Play Store (Android), depending on your device. By subscribing, you agree to the applicable store's payment terms.
• In-app subscription management (including cancellation) is handled by RevenueCat. By subscribing, you also agree to RevenueCat's Terms of Service.
• Your subscription will automatically renew at the end of each billing period unless cancelled before the renewal date.

9.3 Free Trial

We may offer a free trial period for Carmundo Pro. If you do not cancel before the trial ends, your payment method will be charged the subscription fee. You will be clearly informed of any free trial terms before subscribing.

9.4 Cancellation

• You may cancel your subscription at any time through the App Store or Google Play subscription settings.
• Cancellation takes effect at the end of the current billing period. You will retain access to Pro features until that date.
• Carmundo does not offer prorated refunds for partially used subscription periods, except where required by applicable law.

9.5 Refunds

• All refund requests for subscriptions are handled by Apple (App Store) or Google (Play Store) according to their respective refund policies.
• Carmundo has no control over App Store or Play Store refund decisions.
• For EU/EEA consumers, your statutory right of withdrawal may apply within 14 days of initial purchase, subject to exceptions for digital content already accessed.

9.6 Price Changes

We reserve the right to change subscription prices. We will provide advance notice of any price changes through the App or by email. Continued use of your subscription after a price change takes effect constitutes acceptance of the new price.

10. Intellectual Property

10.1 App Ownership

The App, including its design, features, code, and branding (collectively, “Carmundo IP”), is the exclusive property of Carmundo. You may not copy, modify, distribute, sell, or lease any part of the App without our prior written consent.

10.2 Trademarks

“Carmundo,” the Carmundo logo, and associated branding are trademarks of Carmundo. You may not use these marks without written permission.

10.3 Feedback

If you provide feedback, suggestions, or ideas regarding the App, you grant us the right to use such feedback without any obligation or compensation to you.

11. Prohibited Conduct

You agree not to:

• Use the App for any illegal purpose
• Impersonate another person or entity
• Attempt to gain unauthorized access to the App or its systems
• Interfere with or disrupt the App's functionality
• Scrape, crawl, or collect data from the App through automated means
• Use the App to distribute spam or unsolicited communications
• Reverse-engineer, decompile, or disassemble any part of the App
• Create multiple accounts for abusive purposes
• Circumvent any access restrictions (e.g., private or elite club controls)

13. Disclaimers

13.1 “As Is” Basis

The App is provided on an “as is” and “as available” basis. We make no warranties, express or implied, regarding the App's reliability, accuracy, availability, or fitness for a particular purpose.

13.2 No Guarantee of Availability

We do not guarantee that the App will be available at all times or free from errors, interruptions, or security vulnerabilities.

13.3 User Interactions

We are not responsible for interactions between users, whether online or in person. You are solely responsible for your interactions with other users.

14. Limitation of Liability

To the fullest extent permitted by law:

• Carmundo shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the App.
• Our total liability shall not exceed the greater of (a) the total amount you paid Carmundo in the 12 months preceding the claim, or (b) €50.
• We are not liable for any damages, injuries, or losses resulting from in-person meetups or events.
• We are not liable for failed, declined, or disputed payment transactions processed by Stripe or the App Stores.
• We are not responsible for the actions or content of event organizers, including failure to deliver a paid event or to honor a refund.

15. Indemnification

You agree to indemnify and hold harmless Carmundo, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising from:

• Your use of the App
• Your violation of these Terms
• Your User Content
• Your violation of any third party's rights
• Events or meetups you organize or attend through the App
• Any ticket purchases or payments you initiate through the App

16. Modifications to Terms

We may update these Terms from time to time. When we make material changes:

• We will update the “Last updated” date at the top
• We may notify you through the App or via email

Your continued use of the App after changes constitutes acceptance of the updated Terms.

17. Termination

17.1 By You

You may stop using the App and delete your account at any time through the App's settings.

17.2 By Us

We may suspend or terminate your access to the App for any reason, including violation of these Terms, without prior notice.

17.3 Effect of Termination

Upon termination, your right to use the App ceases immediately. Provisions of these Terms that by their nature should survive termination will remain in effect.

18. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of France. Any disputes arising from these Terms shall be resolved through:

1. Informal negotiation (30-day good-faith effort)
2. Mediation if negotiation fails
3. Binding arbitration or courts of competent jurisdiction in France

19. General Provisions

19.1 Entire Agreement

These Terms, together with the Privacy Policy, constitute the entire agreement between you and Carmundo.

19.2 Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions shall remain in full effect.

19.3 Waiver

Our failure to enforce any provision of these Terms shall not be deemed a waiver of that provision.

19.4 Assignment

You may not assign your rights under these Terms. We may assign our rights without restriction.
